By accessing or using our website, services, or content, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our website. We may update these Terms at any time, with changes posted here and effective upon posting.

1. Eligibility and Account Registration

To list properties, submit offers, or upload private videos on GetRealSold.com, you must create a secure user profile ("Account") and become a registered member. Requirements:

• Be at least 18 years old with legal capacity to enter contracts.
• Provide accurate, complete information, including a valid state-issued ID (e.g., driver’s license, passport) for verification.
• Maintain confidentiality of your Account credentials and report unauthorized use to support@getrealsold.com. We may refuse or terminate Accounts for inaccurate information or Terms violations.

2. Use of the Website

GetRealSold.com offers tools for real estate transactions, educational content, and private video submission for property tours. You agree to use the website lawfully and per these Terms.

• Permitted Uses: Browse listings, use contract tools (if registered), view videos (e.g., teaching content, property tours), and submit private videos for review.
• Prohibited Uses: You may not:
  • Post or publicly share videos on the website. Only GetRealSold.com may post approved videos (teaching content, Q&A responses, property tours).
  • Engage in fraudulent, deceptive, or illegal activities.
  • Interfere with website functionality or security.
  • Use automated tools (e.g., bots) without permission.

3. Property Listings and Offers

To list or offer on properties:

• Register with a verified Account, including state-issued ID.
• Provide accurate property/offer information, complying with National Association of Realtors (NAR) and state laws.
• We may review, approve, or remove listings/offers at our discretion.

4. Video Content and Seller Submissions

4.1 Posted Video Content

Only GetRealSold.com posts videos publicly, including teaching content, Q&A responses, and approved property tours. Users may not upload or post videos directly to the website. Posted videos are:

• Owned or licensed by GetRealSold.com and protected by copyright.
• For personal, non-commercial use only. You may not reproduce or distribute them without permission. For real estate questions, visit GetRealHome.com.

4.2 Private Video Submissions

Sellers with a verified Account may submit private videos (e.g., property tours) through our secure upload system for review by GetRealSold.com. By submitting videos, you agree:

• Ownership and Rights: You own or have rights to the video content and grant GetRealSold.com a non-exclusive, royalty-free license to use, edit, modify, or add voice-overs to the video for marketing purposes (e.g., property tours).
• Editing and Voice-Overs: GetRealSold.com may edit submitted videos or add voice-overs to enhance marketing impact, subject to your approval for public posting.
• Privacy: Submitted videos are private and accessible only to GetRealSold.com staff for review. We will not post videos publicly without your consent.
• Compliance: Videos must comply with NAR and state advertising laws (e.g., no misleading representations). We may reject or edit non-compliant videos.
• Liability: You are responsible for ensuring submitted videos do not infringe third-party rights (e.g., copyright for music or images). GetRealSold.com is not liable for issues arising from your submissions.

5. Intellectual Property

All content on GetRealSold.com (text, images, videos, logos), including posted videos, is owned or licensed by Get Real Realty (an A+ Enterprises Inc. company) and protected by intellectual property laws. Submitted videos remain your property, but you grant us usage rights as outlined in Section 4.2. Unauthorized use of our content is prohibited.

6. Third-Party Links and Content

GetRealSold.com may embed third-party content (e.g., Vimeo videos) or link to GetRealHome.com. We are not responsible for third-party content or policies. GetRealSold.com is not liable for third-party content embedded on our site.

7. User Conduct

You agree to:

• Provide accurate information in listings, offers, and video submissions.
• Avoid objectionable content (e.g., defamatory, harassing).
• Comply with real estate and data protection laws. We may remove content or suspend Accounts for violations.

8. Disclaimers and Limitation of Liability

GetRealSold.com is provided "as is" without warranties. Get Real Realty (an A+ Enterprises Inc. company) is not liable for damages from website use, including errors, technical issues, or issues arising from user-submitted videos.

9. Indemnification

You indemnify Get Real Realty (an A+ Enterprises Inc. company) against claims from your use, Terms violations, or infringement of third-party rights, including issues from submitted videos.

10. Termination

We may suspend/terminate access for Terms violations, fraudulent activity, or non-compliant submissions.

11. Governing Law

These Terms are governed by the laws of the jurisdictions we provide services in (Tennessee and Mississippi). Any disputes, including legal complaints arising from your use of GetRealSold.com or these Terms, will be resolved through binding arbitration in Germantown, Tennessee, in accordance with the rules of the American Arbitration Association. You waive the right to participate in class actions or class-wide arbitration.

12. Privacy Policy

Your use, including video submissions and ID data, is subject to our Privacy Policy, governing data collection and protection.
